Welcome to BIN-GO LUXE RIDE’s website. These terms and conditions ("Agreement”) is a legal agreement carefully before you (hereinafter referred to as “you,” “your,” “user”, “client” “rider”) and BIN-GO LOGISTICS LLC DBA BIN-GO LUXE RIDES (hereinafter referred to as "us," 'we," "our," “owner” or “BIN-GO”), concerning your access to and use of BIN-GO’s services, website - https://rides.bingo as well as any other media form, media channel, mobile website or mobile application related, linked, and accounts on any and all social media accounts otherwise connected thereto (collectively, the “website,” “site,” "service"). This website is not tailored to comply with any industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.). If your interactions would be subjected to such laws, you may not use this website. You may not use the website in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

Conditions of use

By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website and our services accordingly. BIN-GO only grants use and access of this website, its products and services to those who have accepted its terms.

Before you continue using our website, we advise you to read our privacy policy, https://www.rides.bingo/privacy-policy, regarding our user data collection. By using this website, you agree to be bound by BIN-GO’s Privacy Policy.

Age restriction

You must be at least 18 (eighteen) years of age before you can use this website. By using this website, you warrant that you are at least 18 (eighteen) years of age and you may legally adhere to this Agreement. BIN-GO assumes no responsibility for liabilities related to age misrepresentation.

Services

BIN-GO offers chauffeured transportation services. Services can be booked through the website. The user must select the pick-up point and the destination point. Service rates can be calculated based on the route or the hours scheduled and requested for the service. The user will be able to select the type of vehicle at the time of scheduling the service.

Users must indicate their location and destination at the time of requesting the service, and BIN-GO will search for the driver that best suits their specifications, location, and destination.

Once the service is scheduled, the user authorizes BIN-GO to communicate with the driver for the purpose of monitoring the trip, assisting the driver with directions or misrouting, course corrections, safety reasons, or for any other reason BIN-GO deems necessary for the proper provision of the service.

Users may also request service for someone other than the person requesting the service. In that case, the user may request and pay for the service by providing the details of the passenger, the address, date and time of collection, and can track the route through our notifications until its completion. At the time of making the request for the service, the user must indicate that the service is for another person or persons and authorizes us to send communications and notifications about the development of the route until its completion.

In case of any complaint or problem related to the service or the driver providing the service, you should contact BIN-GO to handle the complaint. BIN-GO will receive your complaint through our helpdesk and will work promptly to resolve any complaint or problem you may have regarding our service. You will be required to provide us with the necessary information to enable a prompt and appropriate resolution of your complaint or problem.

You agree and acknowledge that you will not use BIN-GO services in cases of medical emergency. In cases of emergency, please seek emergency medical services. BIN-GO is not a provider of emergency medical transportation services.

You understand and agree that situations beyond our control may arise in which drivers become lost, have an accident during the pick-up route, or fail to respond to requests BIN-GO communicates to you regarding your specifications. BIN-GO services and third-party services requested by users are not infallible; the user accepts the risks that may occur during the provision of the services.

Passengers must behave in a respectful and courteous manner with drivers at all times. BIN-GO reserves the right to cancel any service if drivers threaten their physical or moral safety, the safety of the vehicle, or the safety of other passengers, or passengers engage in rude, abusive, disrespectful, threatening, or other behavior that may be considered by any person to be objectionable.

The user declares and accepts that BIN-GO services are provided through affiliated third-party companies. The drivers providing the transportation services requested by users are partners and affiliates and are not employees of BIN-GO.

BIN-GO may cancel any service and may change or discontinue the availability of services at any time in its sole discretion.

Payments

Users will make bookings for services through the website. The services booked through the website will be paid by credit or debit card through Stripe (payment processor available on the website).

The service will be billed according to the type of service selected by the user (point to point and hourly) and by the type of vehicle selected by the user. The total value of the service will be shown in the checkout before confirming the booking. The total value of the service will be automatically charged to the user's credit card or debit card one day before the scheduled time in the booking process (one-time payment). Upon charging the service and processing a transaction, we will issue an electronic receipt that will be sent to the user's email address with the details of the transaction and confirmation of the service on the scheduled date and time. If the user contacts BIN-GO after the booking process to request extra services, the services will be billed through your credit card or payment information.

If you find any inconsistency in your billing, please contact us through our contact details or you can make the claim through the customer service of the relevant payment platform.

If your card is declined, you will receive an error message. No payment will be charged to your card and the scheduled service will be cancelled. Your credit or debit card may be declined for various reasons, such as insufficient funds, AVS (Address Verification System) mismatch, or you have entered an incorrect security code.

If your payment is declined, you will need to provide an alternative payment method or provide another card on which the payment can be charged and processed. If the buyer does not provide a credit or debit card where payment can be processed, the scheduled service will be automatically cancelled.

Important: By completing the booking process for a service on the website and providing your payment details, such as your credit card details, you agree and authorize that the value of the corresponding service shown during the booking process will be charged one day before the booked date for the service to your credit or debit card automatically. The payment of the service will be made in a one-time payment. In cases where the user requests other services after the booking process is completed, the user authorizes BIN-GO to charge for the requested service through your payment information and through our payment processor (Stripe). The value of the extra services requested by the user after the booking process has been completed will be billed together with the service booked through the website.

Your payment details will be processed and stored securely and for the sole purpose of processing the booking of services through the website. BIN-GO reserves the right to engage any payment platform available on the market, which processes your data for the sole purpose of processing the booking of services through the website.

Additional Charges

Wait Time (Airport & Point-to-Point Transfers)

For airport and train arrivals (domestic air/train), BIN-GO offers a 45-minute grace period from the updated arrival time. After the complimentary wait time, waiting time will be charged in 15-minute increments at the vehicle's prevailing hourly rate at $100USD/HOUR.

For all other transfers, a 15-minute grace period will be granted. After the complimentary wait time, waiting time will be charged in 15-minute increments at the vehicle's prevailing hourly rate. Wait time past 30 minutes will revert the trip to hourly minimum pricing.

Stops (Airport & Point-to-Point Transfers)

Additional charges may be incurred for:

Deviations from the requested service, such as extra terminal stops, extra stops en route, waiting time, holiday and late-night surcharges, etc.
Services in areas outside our corporate-owned locations. Vehicles in international markets may incur a mileage charge, in addition to the hourly rate. These charges are subject to the time used and distance traveled.

Admin/Licensing Fee – Surface Transportation Charge

A 10% Administrative Fee for miscellaneous licensing, insurance, and administrative expenses, calculated on the base fare, stop charges, and wait time, will be added to your bill.

Other Charges

Other charges include reimbursement for tolls, parking, and airport, licensing and event fees, WiFi, and client-requested incidentals and amenities.

MEET & GREET SERVICES

Sedans and SUVs

For all domestic arrivals, your chauffeur will meet you at the bottom of the escalators by baggage claim. For international arrivals, your chauffeur will meet you outside customs. Unless a curbside pickup has been requested.

Sprinter vans, stretch limos, and all buses

Curbside pickup only. Please call your chauffeur to meet at the curb outside baggage claim. On request, meet & greet services will be charged at $100 per hour with a 2-hour minimum. The charge for an individual airport meet and greet at LGA is a $200 minimum. Meet & Greet services in other cities will vary by location.

Holiday & Off-Hour Surcharge

A $25 surcharge may be added to the base fare on transfers during the following holidays and between the hours of 11:59 pm and 4:59 am: New Year’s Day, Thanksgiving Day, and Christmas Day. Premium hourly rates may also apply on these holidays and during off-hour times, as well as during other premium events and dates.

Staff Accommodations

On occasions that require overnight travel for chauffeurs, onsite coordinators, or other client-dedicated staff, lodging and meals should be arranged and provided by the client. A per diem may be applied in addition to lodging expenses.

Cancellation policy

If you need to cancel a ride, we encourage you to do so at least hours before the scheduled pickup time. You can cancel through our customer service, via email, or directly within the system. Cancelling within hours of the pickup time may result in cancellation fees, which will be charged to your main payment method. These fees compensate the driver for their time, fuel, and other associated costs.

For specific rides, a cancellation fee or penalty may apply, and it is important to note that a twenty percent 20% cancellation fee (of the total booking fee) will be charged and is non-refundable. In some cases, particularly when using specialty vehicles (such as limos, vans, custom vehicles, SUV limos, etc.), the standard cancellation fee policy may not be applicable. Cancellation fees for these cases will be assessed on a case-by-case basis, and any collected balance may be nonrefundable.

Cancellation Fees and No-Show Policy

After confirming a reservation, you may be liable for a cancellation fee. The cancellation fees will be calculated at twenty percent of the total booking rate.

No-show fees may apply under the following circumstances:

Your driver arrived to pick you up.
Your driver waited for 20 minutes or more.
You contacted the driver or the driver attempted to contact you.

In the case of a no-show, 100% of the booking rate will be collected from the main payment method (credit card on file).

Vehicle capacity

Users may not load vehicles beyond seating and luggage capacities.

Missed flights, appointments and delays

BIN-GO LOGISTICS LLC is not responsible for any missed flights and/or appointments. Additionally, we will not be responsible for any ride delays or terminations due to matters outside of our control, including, but not limited to, traffic delays and unsafe road conditions.

Vehicle alternatives

We reserve the right to switch vehicles based on availability without prior notice if the requested vehicle is unavailable or there is a risk of the chauffeur not arriving on time.

Lost Items and shipping

BIN-GO is not responsible for articles or bags left behind in the vehicle. Shipping fees may apply for items that need to be shipped within the United States.

Rider conduct

BIN-GO reserves the right to refuse to transport persons under the influence of or in possession of illegal drugs, as well as those excessively intoxicated. No possession of firearms or dangerous substances of any kind, or persons who are, or are likely to become objectionable to others, or if the chauffeur feels threatened in any way. Sale or consumption of any type of narcotics or illegal drugs is not permitted. Violations will result in immediate termination of the contract and services, and forfeiture of all paid deposits and fees for service.

You are responsible for your guests, including any damage to the interior and equipment of the vehicle. This includes, but is not limited to: gum, wine and alcohol spillage, vomiting, breakage of drink glasses, breakage of decanters, breakage of lights, television, DVD player, radio, and CD player. Repair and replacement of items shall have a minimum charge of at least $200USD. If anyone gets sick in the vehicle, there will be a $500USD cleanup charge.

All passengers agree to behave in an orderly and respectful manner. BIN-GO reserves the right to expel any person from the vehicle and/or terminate this contract in the event of a violation of any of these conditions by any passenger. In the event of such early termination, no portion of the rental fees will be refunded.

Under no circumstances are minors allowed to consume or possess alcohol or illegal substances while in a company vehicle. The client shall not interfere with the chauffeur in the discharge of their duties or tamper with any apparatus or appliance in the vehicle. In such instances, services will be terminated immediately, and no refunds will be offered.

International privacy laws and your rights under GDPR

If you are visiting the Site from outside the United States, please be aware that you are sending information to the United States where our servers are located. Information you submit may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by BIN-GO. These countries (including the United States) may not necessarily have data protection laws as comprehensively protective as your country of residence; however, our collection, storage, and use of your data will at all times continue to be governed by this Privacy Policy. If you are a member of the European Union (EU), you have special rights under the GDPR. Those include: You have the right to object to the processing of your data and the right to portability of your data. All complaints must be sent to: contact@rides.bingo. You also have the right to erasure, rectification, access, or to seek restrictions to the processing of your personal data in our system. To the extent you provide consent to our processing of your personal data, you have the right to withdraw that consent at any time. Any withdrawal of consent does not apply to data collected lawfully prior to such consent. You have the right to lodge a complaint with a supervisory authority containing jurisdiction over GDPR related issues.

Intellectual property

You agree that all materials, products, and services provided on this website are the property of BIN-GO, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and any other intellectual property. You also agree that you will not reproduce, duplicate, redistribute, sell, rent, sublicense, or otherwise exploit the BIN-GO’s intellectual property in any way, including electronic, digital, or new trademark registrations.

You grant BIN-GO a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the BIN-GO in order to come to an agreement.

User representations

By using the website, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these terms and conditions; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the website through automated or non-human means, whether through a bot, script or otherwise; (4) you will not use the website for any illegal or unauthorized purpose; and (5) your use of the website will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

Acceptable use

You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without BIN-GO’s written consent.

You must not use this website to transmit or send unsolicited commercial communications.

You must not use this website for any purposes related to marketing without BIN-GO’s express written consent.

User accounts

As a user of this website, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.

Website corrections

The information on the website and within our products or services may contain typographical errors, inaccuracies, or omissions, including without limitations, descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the website at any time, without providing prior notice to you.

User generated contributions

This website may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the website, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the website and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

Contribution License

BIN-GO is not responsible for the content or reliability of the linked third-party websites. BIN-GO provides these links for your convenience only but does not endorse the material on the third-party websites.

Advertisements and links

BIN-GO may allow advertisers to display their advertisements and other information in certain areas of the website, such as sidebar advertisements or banner advertisements. If you are an advertiser, you shall take full responsibility for any advertisements you place on the website and any services provided on the website or products sold through those advertisements. Further, as an advertiser, you warrant and represent that you possess all rights and authority to place advertisements on the website, including, but not limited to, intellectual property rights, publicity rights, and contractual rights. As an advertiser, you agree that such advertisements are subject to our Digital Millennium Copyright Act (“DMCA”) Notice and Policy provisions as described below, and you understand and agree there will be no refund or other compensation for DMCA takedown-related issues. BIN-GO reserves the right, but not the obligation, to: (1) monitor the website for violations of this Agreement; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or this Agreement, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the website.

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable.

No warranties

This website is provided “as is” without any representations or warranties, express or implied. BIN-GO makes no representations or warranties in relation to this website or the information, materials, products and services provided on this website.

Indemnification

Limitation on liability

BIN-GO is not liable for any damages or loss, of any kind, that may occur to you as a result of your misuse of our website.

BIN-GO reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between BIN-GO and the user, and this supersedes and replaces all prior agreements regarding the use of this website.

These limitations of liability apply even if BIN-GO has been expressly advised of the potential loss.

Exceptions

Nothing in this Agreement will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit BIN-GO liability in respect of any:

death or personal injury caused by BIN-GO’s negligence;
fraud or fraudulent misrepresentation on the part of BIN-GO or
matter which it would be illegal or unlawful for BIN-GO to exclude or limit, or to attempt or purport to exclude or limit, its liability

Waiver

The failure by BIN-GO to enforce at any time or for any period any one or more of the terms and conditions shall not be a waiver of them or the right at any time subsequently to enforce all terms and conditions.

Severance

If any provision of these terms and conditions shall be found by any court to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these terms and conditions which shall remain in full force and effect.

If any provision of these terms and conditions is so found to be invalid or unenforceable but would be valid or enforceable if some parts of the provision were deleted, the provision in question shall apply with such modification(s) as may be necessary to make it valid and enforceable.

Variation

We may revise these terms and conditions from time to time. Revised terms and conditions will apply to the use of our website from the date of the publication of the revised terms and conditions on our website. Please check this page regularly to ensure you are familiar with the current version.

Entire agreement

These terms and conditions constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

Governing law

BIN-GO may cancel any service and may change or discontinue the availability of services at any time in its sole discretion.

Payments

Users will make bookings for services through the website. The services booked through the website will be paid by credit or debit card through Stripe (payment processor available on the website).

If you find any inconsistency in your billing, please contact us through our contact details or you can make the claim through the customer service of the relevant payment platform.

Additional Charges

Wait Time (Airport & Point-to-Point Transfers)

Stops (Airport & Point-to-Point Transfers)

Additional charges may be incurred for:

Deviations from the requested service, such as extra terminal stops, extra stops en route, waiting time, holiday and late-night surcharges, etc.
Services in areas outside our corporate-owned locations. Vehicles in international markets may incur a mileage charge, in addition to the hourly rate. These charges are subject to the time used and distance traveled.

If you have any questions regarding these or any other charges, please call a BIN-GO representative.

Admin/Licensing Fee – Surface Transportation Charge

A 10% Administrative Fee for miscellaneous licensing, insurance, and administrative expenses, calculated on the base fare, stop charges, and wait time, will be added to your bill.

Other Charges

Other charges include reimbursement for tolls, parking, and airport, licensing and event fees, WiFi, and client-requested incidentals and amenities.

Cancellation policy

Cancellation Fees and No-Show Policy

After confirming a reservation, you may be liable for a cancellation fee. The cancellation fees will be calculated at twenty percent of the total booking rate.

No-show fees may apply under the following circumstances:

Your driver arrived to pick you up.
Your driver waited for 20 minutes or more.
You contacted the driver or the driver attempted to contact you.

In the case of a no-show, 100% of the booking rate will be collected from the main payment method (credit card on file).

Vehicle capacity

Users may not load vehicles beyond seating and luggage capacities.
